Why?  Are you saying that silently doing nothing in this case is
better?

I could agree to have the "Send to..." item disabled if there's
nothing to send, but if that's not practical, IMO a user-error is
fine.

It's advisable to not clutter the menu with items that has no effect.

We could do that, although IME having an item disappear from menu is
surprising and I tend to consider it a bug or some problem with the
software which does that.  So I prefer leaving the item, but making it
disabled.  That is also better for discoverability.
